Terms of service.

Welcome to Curtyn. By accessing or using our service you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.
1. Description of service
Curtyn is a workspace platform for creative professionals (“Creators”). The platform provides project management, file storage and delivery, controlled share links, PDF export, and related production planning tools. The service is operated by Curtyn (“we”, “us”, “our”).
“Curtyn” is a trade name of Ruben Wijnheijmer, a sole proprietorship (eenmanszaak) established in the Netherlands. Our details are:

Additional features including time tracking, drive tracking, digital signatures, and embeddable video players are planned for future release. These Terms will be updated when those features become available.
2. Accounts
Creators must register for an account to use the platform. You must be at least 16 years of age to register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. People you share work with access it via unique share links and do not require an account.
3. Plans and pricing
Curtyn offers a free tier and a paid “Curtyn Pro” subscription. Pro is billed monthly at the price displayed at the time of your subscription and processed securely via our payment partner, Mollie. You may cancel at any time; access continues until the end of your current billing period. We do not offer prorated refunds for mid-period cancellations unless required by applicable law.
We may change pricing for new subscribers at any time. If you subscribed at a promotional or early-access price, that price remains locked for you as long as your subscription stays active and in good standing. If you cancel and re-subscribe, the current published price applies.
Right of withdrawal (consumers). If you are a consumer in the European Union, you normally have a 14-day right to withdraw from a distance contract. Because Curtyn Pro is a digital service that begins immediately, by subscribing you expressly request that we start providing the service during the withdrawal period and acknowledge that you lose your right of withdrawal once the service has been fully performed. Until then you may withdraw by emailing support@curtyn.com; we will refund the unused portion in line with applicable law.
4. Usage limits and fair use
Each plan includes specific resource allowances. These limits are designed to support the vast majority of creative workflows while keeping the service sustainable for all users.
4.1 Storage
The free tier includes 2 GB of storage. If you approach your storage limit, we will notify you at 80% usage. When you reach your limit, you will not be able to upload new files until you free up space.
Paid plans, where available, include higher storage limits and options to add additional storage. The specific allowances, overage behaviour, and any add-on pricing for a given plan are published in your account settings at the time you subscribe and take precedence over any historical figures referenced elsewhere.
4.2 File uploads
There is no per-file size limit. Individual file uploads are constrained only by your available storage quota. We reserve the right to introduce reasonable per-file size limits in the future with 30 days’ notice if necessary to maintain service performance.
4.3 Team seats
Curtyn Pro includes one (1) seat. Additional seats may be purchased as an add-on at the per-seat price published at the time of purchase. Team members invited under the free subscriber model receive access to the inviting owner’s project features at no additional cost to the subscriber, but this access is limited to projects they are explicitly invited to.
4.4 Processing and delivery
Curtyn Pro includes generous processing resources for typical creative workflows, including video transcoding, thumbnail generation, and file delivery via share links. We do not meter outbound bandwidth or charge delivery fees.
We reserve the right to contact accounts whose processing usage significantly and persistently exceeds patterns typical of professional creative work. In such cases, we will work with you to find a suitable arrangement before taking any action that affects your access to the service. We will not suspend or throttle your account without at least 14 days’ written notice, except in cases of clear abuse or activity that threatens service availability for other users.
4.5 Changes to limits
We may adjust plan limits from time to time. If we reduce limits that affect your existing usage, we will give you at least 30 days’ notice and grandfather your current usage level for a reasonable transition period.
5. Acceptable use
You must not use Curtyn to:
- Violate any applicable laws or regulations.
- Infringe the intellectual property rights of any third party.
- Transmit spam, malware, or other harmful content.
- Impersonate any person or entity.
- Interfere with or disrupt the integrity of the service.
- Use the platform primarily as a general-purpose file hosting or CDN service unrelated to creative project work.
- Automate uploads, downloads, or API access in a manner that degrades the service for other users.
6. Content Ownership & Copyright Liability
You retain full ownership of all content you upload to Curtyn. By uploading content, you grant us a limited, non-exclusive license to host, transcode, display, and transmit that content solely for the purpose of providing the service to you.
- Your Responsibility: You represent and warrant that you own or have the necessary licenses, rights, and permissions to upload and share all content (including video, audio tracks, and images) in your workspace.
- Zero Liability for Infringement: Curtyn acts solely as a neutral hosting provider. We do not monitor user projects and hold absolutely no liability for copyright infringement committed by our users.
- Takedown Requests: We comply with applicable copyright laws (including the EU Digital Services Act and the DMCA). If we receive a valid copyright infringement notice regarding files hosted in your account, we reserve the right to immediately remove or disable access to the infringing content, and in cases of repeated abuse, terminate your account.
7. Indemnification
You agree to indemnify and hold Curtyn, its founder, and affiliates harmless from any claims, damages, liabilities, and legal fees arising from your use of the platform, including but not limited to claims of copyright infringement, data breaches of your clients’ information, or your violation of these Terms.
8. Data Loss and Backups
While we utilize enterprise-grade cloud storage and routine database backups, Curtyn is not a dedicated backup service. You are strictly responsible for maintaining independent backups of all original raw media, files, and documents. We hold no liability for data loss, file corruption, or business interruption resulting from system failures, accidental deletion, or third-party infrastructure outages.
9. Service availability
We aim to provide a highly reliable service, but we do not guarantee any specific uptime. We may modify, suspend, or discontinue parts of the service at any time with reasonable notice. If we discontinue the service entirely, we will provide at least 30 days for you to export your data.
10. Limitation of liability
To the fullest extent permitted by law, Curtyn shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, loss of data, or production delays) arising out of or relating to your use of the service. Our total aggregate liability for any claim arising out of these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud, or for intent or gross negligence (opzet of bewuste roekeloosheid). If you are a consumer, your statutory rights under mandatory consumer-protection law are not affected by this section.
11. Governing law
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or the service shall be submitted exclusively to the competent courts in the Netherlands. If you are a consumer resident in another EU member state, this does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring or be subject to proceedings in the courts of your place of residence where applicable law so requires.
12. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance of the updated Terms. If you disagree with the changes, you may cancel your subscription before they take effect.
13. Data protection
Our handling of personal data is described in our Privacy Policy. Where you use Curtyn to process personal data of third parties (for example cast, crew, or client contact details), you act as the data controller and we act as your processor. That processing is governed by our Data Processing Agreement, which forms part of these Terms and is incorporated by reference.
14. Force majeure
We are not liable for any failure or delay in performing our obligations where that failure or delay results from causes beyond our reasonable control, including outages or failures of third-party infrastructure providers, network or power failures, denial-of-service attacks, or acts of government.
15. General
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be replaced by a valid one that most closely reflects its intent. Our failure to enforce any right is not a waiver of it. You may not assign or transfer your rights under these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, Acceptable Use Policy, and Data Processing Agreement, constitute the entire agreement between you and us regarding the service.
